Lexicall (the "Service") is a product of Lexico Telecom Limited. (hereafter "we" and "us" refer to this company). We own the intellectual and commercial rights to the Service and everything related to it (the site and all posted information). The use of this product will only be possible with the full and unconditional consent of the person/company (hereinafter referred to as the "Client"). Failure to comply with the terms of this Agreement will be grounds for refusal to provide the Service. We reserve the right to add/delete/change any part of this document. The current version of the Agreement is always available on the website of the Service. The Agreement also applies to all components that will be created/developed within the Service in the future.
The Service must not be used for any illegal actions and operations aimed at harming us, our clients, or third parties/companies, spreading malicious code, conducting DDoS or other types of attacks. We are not responsible for any actions that the client commits about us or third parties, nor for any losses incurred by the client as a result of such actions. We are not responsible for the failure of any equipment on the Client side. We do not guarantee the continuity of the Service and are not responsible for losses incurred as a result of its unavailability. We reserve the right to refuse registration / terminate the provision of the Service (or part thereof) to any Client at any time without any explanation.
The client uses the Service provided by us. The Client and we acknowledge that it is in our mutual interest to adequately plan the required necessary capacity to enable the efficient provision of the Service. The Client and I will be responsible for procuring and managing at our own expense the necessary equipment or facilities required to bring its operation to the handover site by the specifications. We are constantly working to improve the quality of the routes provided, however, the Customer remains fully responsible and is the single point of contact for all its customers about the Service provided by us.
The service is a prepaid device, and the Client pays the fee and is charged "in advance". Lack of payment / a sufficient amount on the Client's balance to pay for the services may cause the Service to be suspended until the required payment is received. The Client ensures the security of logging into the Service. Their unauthorized use by third parties is not a reason to change the value of the service already provided. Price changes on the Service side will be made after prior notification of the Client, sent 7 days before the introduction of such changes, to the Client's electronic mailbox specified during registration (or modified later). Non-receipt of the letter for reasons beyond our control is not a reason for maintaining previous costs.
Personal information of Clients collected by the Service refers to; Client Name, email address, and (in some cases) telephone numbers. Personal data of Clients is collected by the Service for customer support, notifications, and updates from the Service (such as; financial, and technical), as well as for security purposes, audit, and internal research to improve the quality of the service. Personal data is only stored on digital electronic devices. Personal data are not transferred to any third parties, except in cases of inquiries by state authorities.
We shall not be liable to you for any consequential, indirect, special, incidental, punitive, or exemplary damages for any cause of action, whether in contract, tort (including negligence, product liability, strict liability, or any other theory), or otherwise. except in the event of a breach of any obligation or restriction concerning the use or protection of confidential information and intellectual property. We have no responsibility or liability for any failure to terminate calls, whether for any reason or no reason, including, without limitation, the failure of other network vendors to terminate such calls.
Our obligations under this Agreement are subject to, and we shall not be liable for, delay in, failure to perform, damage to, loss of, or destruction of, or malfunction of, any equipment or any consequence thereof caused or caused by events beyond our reasonable control, including but not limited to fire, flood, water, the elements, labor disputes, curtailment of public services, power outages, explosions, civil unrest, government actions, lack of supply equipment, unavailability of transportation, acts or omissions of third parties.
This Agreement constitutes the entire understanding and agreement between the Client and us. None of the rights or obligations under this Agreement shall be assigned or transferred by the Client without prior written consent.
